1972年國際海上避碰規則之修正

 

本大會,憶及1972年國際海上避碰規則公約(以下稱「本公約」)第六條對「本規則之修正」之有關規定。

經考慮根據公約第六條第二項之規定,已由海事安全委員會於其第八十二次會議中所採納並通知各締約國,對1972年國際海上避碰規則之修正條文,以及海事安全委員會有關此項修正案生效之建議。

1.根據公約第六條第三項之規定,採納本決議案附件之修正案:

2.根據公約第六條第四項之規定,決定各項修正案將於2009121生效,除非在200861前有三分之一以上之締約國提出並通知對修正案之反對;

3.要求秘書長遵照第六條第三項之規定,將本決議案通知公約之全體締約國接受;

4.敦請各簽約國於200861前提出對修正案之任何反對意見,逾時則依照公約第六條第四項之規定視同接受本決議案所決定對本修正案之生效。

 

 

附錄肆 遇難信號

一、下列信號,可單獨或合併使用或顯示,以表示遇難及需要救助:

()約每隔一分鐘鳴放一次之槍砲聲或其他爆炸信號;

()以任何霧中信號器具發出之連續聲響;

()每隔短時間發射一次有紅色星簇之火箭或爆彈;

()以無線電報或任何其他通信方法,發送之包含摩斯代碼...---...SOS)之信號;

()以無線電話發出包含口語「Mayday」一字之信號;

()N.C.表示之國際代碼遇難信號;

()以方旗一面及其上方或下方之球形物或類似球形之物所組成之信號;

()船上施放之火焰(如燃燒柏油桶或油桶等);

()發出紅光之火箭降落傘光焰及手持式光焰;

()散放橙色煙霧之煙霧信號;

(十一)兩臂左右外伸,緩慢上下重覆揮動之;

(十二)以數位選擇呼叫(DSC)發送之下列頻道遇難信號。

(1)特高頻70,或

(2)中頻/高頻,頻率2187.5KHz

8414.5 KHz4207.5 KHz

6312. KHz12577 KHz16804.5 KHz

(十三)由船上發出之船上衛星通信之船對岸遇難信號或其他船上衛星電台提供之其他衛星通信。

(十四)經由應急指位無線電示標發出之信號。

(十五)由無線電通信系統,包含救生艇筏雷達詢答機,發送經認可之信號。

二、前項所述任何信號,除為表示遇難需要救助外,禁止使用及顯示。可能與前項相混淆之其他信號,亦禁止使用。

三、國際代碼信號,國際海空搜救手冊第Ⅲ冊中有關各節,以及下列信號,均應予以注意:

()橙色帆布上加黑色方塊與圓形,或其他適當之標識(用以對空識別);

()一個染色標識。

ADOPTION OF AMENDMENTS TO THE INTERNATIONAL REGULATIONS FOR PREVENTING COLLISIONS AT SEA, 1972

THE ASSEMBLY,

Recalling article VI of the Convention on the International

Regulations for Preventing Collisions at Sea, 1972, (hereinafter referred

to as "the Convention"), on amendments to the Regulations,

HAVING CONSIDERED the amendment to the International Regulations for Preventing Collisions at Sea, 1972, adopted by the Maritime Safety

Committee at its seventy-third session and communicated to all

Contracting Parties in accordance with paragraph 2 of article VI of

the Convention; and also the recommendations of the Maritime Safety

Committee concerning the entry into force of these amendment,

1. ADOPTS, in accordance with paragraph 3 of Article VI of the

Convention, the  amendment set out in the Annex to the present

resolution;

2. DECIDES, in accordance with paragraph 4 of Article VI of the

Convention, that the amendment shall enter into force on 1

ecember 2009  unless by 1 June 2008  more than one third of the

Contracting Parties have notified their objection to the amendments;

3. REQUESTS the Secretary-General, in conformity with paragraph 3 of Article VI of the Convention, to communicate this resolution to all Contracting  Parties to the Convention for acceptance;

4. INVITES Contracting Parties to submit any objections to the

amendment not later than 1 June 2008 whereafter the amendment will be deemed to have been accepted to enter into force as determined in the present  resolution. In accordance with the provisions of paragraph 4 of drticle VI of the comvention.

AMENDMENTS TO THE INTERNATIONAL REGULATIONS FOR PREVENTING

COLLISIONS AT SEA, 1972, AS AMENDED

Annex IV

Distress signals

1.  The following signals, used or exhibited either together or separately, indicate distress and need of assistance:

(a) a gun or other explosive signals fired at intervais of about a minute;

(b) a continuous sounding with any fog-signalling apparatus;

(c) rockets or shells, throwing red stars fired one at a time at shot lntervals;

(d) a signal made by any signaling method consisting of the group. …---… (sos) in the Morse Code;

(e) a signal sent by radiotelephcny consisung of the spoken word"MAYDAY"

(f) the lnternational Code signal of distress indicated by N.C.

(g) a signal cnsisting of a square flag having above or below it a call or anything resembling a ball;

(h) flames on the vessel (as from a burning tar barel. Oil barrel etc);

(i) a rooket parachute flare or a hand-flare shcwing a red light;

(j) a smoke signal giving off orange-coloured smoke;

(k) slowly and repeatedly raising and lowering arms outstretched to each side;

(l) a distress alert by means of digital selective calling (DSC)transmitted on;

(i)VHF channel 70, or

(ii)MF/HF on the frequencies 2187.5 KHz, 8414.5KHz, 4207.5KHz, 6312KHz, 12577KHz or 16804.5KHz;

(m) a ship-to-shore distress alert transmitted by the ships lnmarsat or other mobile satellite service provider ship earth station;

(n) signals transmitted by emergency position-indicating radio beacons;

(o) approved signals transmitted by radiocommunications systems. Including survival craft radar transponders.

2.  The use or exhibition of any of foregoing signals, except for the purpose of indicating distress and need of assistance and the use of other signals which may be confused with any of the above signals, is prohibited.

3.  Attention is drawn to the relevant sections of the International Code of Signals;the internationalAeronautical and Maritime Search and rescue manual volumeand the following signals

(a) a piece of orange-coloured canvas with either a black square and circle or oether approoriate symbol (for identification from the air).
